Civil Cases:

Ralston v. Harrelson - The City of Cedar Rapids settled with two female plaintiffs after a lawsuit was filed concerning a police officer's misconduct/harassment while the officer was on duty.

Schumacher v. Lisbon School Board - A family prevailed in securing an open school board meeting concerning the school staff's disciplinary actions toward their child, and the Iowa Supreme Court upheld the ruling including the district court's award of attorney fees.

Criminal Cases:

Federal

White v. Helling - Following a federal court's reversal on appeal, Sherman White was released from prison after serving 31 years on a wrongful murder conviction.

U.S. v. Duffer - The Defendant was acquitted of conspiracy to import 10,000 pounds of marijuana from Mexico, thereby defying a prosecutors assertion that the Defendant's case was "unwinnable."

U.S. v. Jacobs - Following convictions on two of five counts related to Defendant's possession of one pound of cocaine, an assault rifle, and an illegal shotgun, Defendant's post-trial motion for acquittal and his appeal to the 8th Circuit resulted in his release from custody.

U.S. v. Reschly - A federal district court threw out evidence seized by law enforcement in violation of the defendant's constitutional rights.

State

State v. Carnicle - A Scott County Clerk of Court employee was acquitted by a Linn County jury of first degree theft charges.

State v. Donald - A 1996 rape conviction was appealed while defendant was serving a mandatory 17½ year prison sentence. The conviction was overturned on appeal and remanded for retrial in 2004. Defendant was released from prison in December of 2004 after serving nine years.

State v. Estephan - The defendant was acquitted by a Johnson County jury of assault and willful injury charges and of three lesser included assault charges.

State v. Forkenbrock - The Iowa District Court suppressed one pound of marijuana located by law enforcement in an illegal search. Police officers were responding to a party and testified that they could smell marijuana. Officer's used the smell as justification for their subsequent illegal search. Police officers were also prevented from using a defendant's arrest in the apartment building's hallway to justify a search of the apartment itself.

State v. J.A.N. - The State's request to prosecute a juvenile as an adult was denied, a murder confession was suppressed, and the first degree murder charge was dismissed.

State v. Minssen - The Clinton County Attorney's Office dismissed charges of operating while intoxicated following a District Court order finding the defendant's constitutional rights were violated. The District Court's findings were upheld after the Iowa Supreme Court denied the State's application for review.

State v. Petrak - The defendant was arrested for possession of a controlled substance (marijuana) after a search of his person at a University of Iowa dormitory. Following a hearing, the district court found that the defendant did not voluntarily consent to this search. The court threw out the evidence discovered by the search.

State v. Seager - Alleged murder weapon suppressed in double homicide; first degree murder charges were dismissed.

State v. Seering - The Washington County District Court granted the Defendant's request to dismiss the State's prosecution in a case of first impression. The Iowa Supreme Court did reverse the District Court after more than a year with two justices dissenting.

State v. Stout - Following a hearing, the District Court in Washington County threw out evidence gathered in the defendant's home and on his property pursuant to an unconstitutional search by law enforcement.

State v. Watson - After having been convicted of first degree murder by a Jones County jury, defendant's conviction was overturned and he was granted a new trial upon appeal. On the eve of the second trial, defendant's defense team was able to reach an agreement with the prosecution permitting the defendant to plead to two consecutive 10-year sentences and one concurrent sentence. This agreement resulted in the Defendant being immediately eligible for parole.

State v. Wilkerson - A Defendant charged with vehicular homicide was able to plead to an aggravated misdemeanor and receive a deferred judgment following a suppression hearing. The Johnson County District Court threw out a blood test and found that the Iowa State Patrol had violated implied consent procedures under Iowa's operating while intoxicated statutes.

B.B v. C.B. - Father wins custody of six-year-old and four-year-old; mother ordered to pay child support.

S.C. v. D.C. - Wife wins enforcement of prenuptial agreement, alimony, and attorney fees

C.B. v. S.Z. - Guardianship is terminated, and father wins custody of two-year-old daughter after trial court finds that he has taken “extraordinary steps” to maintain their relationship.

Guardianship of Z.B. - Grandparents win rights to custody and to limit visitation between mother and child.

J.T. v. A.H. - Father wins right to custody of four-year-old daughter; mother ordered to pay child support based on full-time hours despite working only part-time.

M.P. v. P.P. - Mother wins custody, alimony, house, and attorney fees.
